The rules of the road for using Greyhosting services, operated by Hostigger Inc.
These Terms of Service ("Terms") govern your access to and use of the websites, hosting services, and other products offered by Hostigger Inc. By creating an account, ordering a service, or using any part of our platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Accounts are activated once payment has been received and any identity or fraud checks we may run have completed successfully. We reserve the right to delay or decline activation if a submission appears incomplete, fraudulent, or in violation of these Terms. The account holder is responsible for keeping login credentials confidential and for all activity that occurs under the account.
By placing an order, you confirm that the information you submit is accurate and that you are authorized to use the payment method provided. Pricing displayed at checkout is the binding price; promotional discounts only apply to the initial term unless explicitly stated otherwise.
Services are billed in advance on a recurring basis (monthly, quarterly, semi-annually, or annually depending on the cycle you select). Invoices are issued before the renewal date and payment is automatically attempted using the payment method on file. If a payment fails, we will notify you and attempt to collect again before suspending or terminating the service.
Service fees do not include taxes, duties, or third-party transaction charges, which are your responsibility where applicable.
All fees are quoted in US dollars unless otherwise specified. Add-on services (additional storage, IP addresses, license upgrades, control panels, backup retention, etc.) are billed separately and follow the same renewal cycle as the parent service unless purchased as a one-time item.
Eligible shared and reseller hosting plans come with a 15-day money-back guarantee from the date of activation. To request a refund, contact our billing department within the 15-day window and provide your invoice details. Refunds are not available for VPS, VDS, dedicated servers, domain registrations or transfers, SSL certificates, software licenses, setup fees, or any customized configurations once provisioned.
Chargebacks initiated without first contacting us will result in immediate account suspension and may incur recovery fees.
We perform routine backups of shared hosting environments as a courtesy, but you are ultimately responsible for maintaining your own backups of all data hosted on our servers. We make no guarantee as to the availability, frequency, or completeness of any backup we may keep, and we disclaim liability for any data loss except as required by applicable law.
Plans marketed as "unlimited" or "unmetered" bandwidth are intended for typical website and application use. Excessive consumption that materially impacts the experience of other customers on shared infrastructure may, in our reasonable judgment, require migration to a higher-tier plan or a dedicated resource.
You may not use our services to store, distribute, or link to content that is unlawful, infringing, fraudulent, or that violates the rights of third parties. The following categories are explicitly prohibited:
Any attempt โ whether successful or not โ to gain unauthorized access to our infrastructure, other customer accounts, or any third-party systems via our network is strictly prohibited. This includes port scanning, brute-force attacks, exploitation of vulnerabilities, DDoS participation, and the operation of botnets or cryptocurrency mining services that consume disproportionate shared resources.
We may suspend or terminate accounts that are in material breach of these Terms, that fail to pay invoices after reasonable notice, or that pose a security risk to our infrastructure or other customers. Where feasible we will notify you in advance; in cases of active abuse, suspension may be immediate.
You represent that you are not located in, under the control of, or a national of any country subject to a comprehensive United States embargo, and that you do not appear on any U.S. government list of restricted parties. Services may not be exported, re-exported, or made available to such persons or jurisdictions.
We reserve the right to refuse service to any individual or organization, at our sole discretion, where we reasonably believe doing so is necessary to protect our infrastructure, our other customers, or the integrity of our business. We will issue a prorated refund of unused service fees where a refusal is not due to a material breach of these Terms.
We target a network and infrastructure uptime of 99.5% (or higher, where specified on a particular product page) measured monthly. Uptime calculations exclude scheduled maintenance windows announced in advance, force majeure events, and downtime caused by customer action or third-party software. Where we fail to meet the published guarantee, eligible customers may request a service credit equal to a pro-rata portion of the affected month.
If you identify a violation of these Terms occurring on our network โ including spam, abuse, or copyright infringement โ please report it to [email protected]. We investigate every credible report and act promptly where appropriate.
To the maximum extent permitted by law, Hostigger Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities arising out of or related to your use of our services. Our aggregate liability for any claim shall not exceed the amount you paid us for the affected service in the three months immediately preceding the event giving rise to the claim.
Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be uninterrupted, error-free, or completely secure.
We may update these Terms from time to time to reflect changes in our services, applicable laws, or industry practices. Material changes will be announced in advance via email or a notice in the client area. Continued use of our services after the effective date of an update constitutes acceptance of the revised Terms.
